FundBrick values your privacy and is committed to protecting your personal information. This Privacy Policy (“Policy”) outlines the rigorous standards we follow when we collect and use your personal information on our mobile application (the “Platform”). While we strive to make the Policy as transparent as possible, we understand that you may have additional concerns. If you have questions, please email us at support@fundbrick.com.


By using FundBrick, you agree to this Policy and consent to the terms below.


APPLICATION OF THIS POLICY


This Policy applies to all personal information we collect from or about you through on our Platform. Personal information is non-public information that can identify you, such as your name, email address, or mailing address. This Policy does not apply to personal information collected by any third party, including through any application or content that may link to or be accessible from our Platform. 


PERSONAL INFORMATION


We collect personal information in a variety of ways, including when you use our Platform or communicate with us. Personal information includes:


  • Contact information, such as your name, Social Security Number, email address, mailing address, and phone number;


  • Account information, such as your username, password, and account preferences;


  • Payment information, such as your credit card number, bank account and routing numbers, and other financial account information;


  • Information about your device, such as your IP address and operating system;


  • Geolocation information, such as Wi-Fi or GPS data on the longitude and latitude coordinates of your location;


  • Information about your use of our Platform, such as the pages you visit and the time and date of your visits; and


  • Information you provide when you participate in surveys or promotions.


CHILDREN'S INFORMATION 


We do not intend for our services to be used by children under 18 years of age. If we discover that we have accidentally collected personal information from a child under the age of 18, we will delete it immediately, unless we are required by law to keep the data. If you think we have collected information from a child under 18 years old by mistake, please contact us.


USE OF COOKIES 


When you use our Platform or a third-party website that we provide online services for, we may use cookies and other tracking technologies, which are called cookies. Cookies help us to recognize you as a customer, personalize our services and advertising, evaluate the effectiveness of promotions, conduct a wide range of analytics, minimize risks and prevent potential fraud, and build trust and safety throughout our Platform. Some of our services are only available if you enable cookies. If you choose to disable or reject cookies, you may not be able to use certain features of our Platform. 


COLLECTION OF PERSONAL INFORMATION 


Our main goal for collecting personal information is to provide a secure, smooth, efficient, enjoyable, and personalized experience for you. We may use your personal information to:


  • Process investments and other transactions;


  • Provide services such as identity verification, account maintenance, and other technical support services;


  • Provide customer support, including responding to your inquiries and sending you notices about your transactions or account;


  • Resolve disputes relating to any transactions;


  • Comply with United States laws and regulations;


  • Identify, stop, and safeguard against security breaches, fraudulent behavior, and activities that are forbidden or unlawful;


  • Provide you with location-specific content, such as location-specific recommendations and security features; and


  • Improve our services by analyzing how users interact with our Platform, developing new products and features, and debugging errors.


PROTECTION AND STORAGE OF PERSONAL INFORMATION 


To protect your personal information from loss, theft, misuse, and unauthorized access, disclosure, alteration, and destruction, we keep and process your data on servers that are protected by physical, electronic, and procedural safeguards in accordance with United States federal and state laws and regulations. These servers may be located outside of the United States. To ensure security, we use computer safeguards like firewalls and data encryption, and we control physical access to our office and files. We also authorize access to personal information only for employees who need it to perform their job responsibilities.


Although we work hard to secure our systems, we cannot guarantee that personal information won't be accessed, disclosed, altered, or destroyed due to a security breach. Therefore, we encourage you to take adequate precautions to protect your personal information, such as not sharing your FundBrick password with anyone.


If we discover a security breach, we may notify you electronically so that you can take appropriate protective steps. By using our Platform, you agree that we may communicate with you electronically. We may post a notice on our Platform or send an email to the address you provided. Depending on where you live, you may have the right to receive notice of a security breach in writing. To withdraw your consent from receiving electronic notice or to request to receive written notice of a security breach, please email us at support@fundbrick.com.


HOW LONG WE STORE YOUR PERSONAL INFORMATION 


We keep your personal information for as long as necessary or allowed based on the purpose for which it was collected and consistent with applicable laws. Personal information used for the ongoing relationship between you and FundBrick is kept for the duration of the relationship plus five years, unless we need to keep it longer due to legal obligations, such as anti-money laundering obligations, or compliance with the law. In addition, we may retain your personal information for litigation, investigations, audits, compliance practices, or to protect against legal claims in accordance with applicable laws and regulations.


DISCLOSURE OF PERSONAL INFORMATION 


We may need to disclose your personal information in the following circumstances:


  • When you make investments through FundBrick, we may need to disclose information such as your contact information to the person or company you are paying or receiving payment from. When we work with banks to accept money from you, they may share information about you with us. We will not disclose your credit card number or bank account number to anyone you have invested through FundBrick, unless required by law or with your express permission. 


  • If you connect your FundBrick account to other financial accounts, either directly or through a third-party service provider, FundBrick may receive information from the third-party about you and your use of the third-party’s service. More specifically, FundBrick may have access to your financial account balance and account and transactional information, such as your purchases and funds transfers.  


  • FundBrick will not send your personal information to third-party social networks unless you specifically request or authorize them to do so. When you broadcast information to third-party social networks, this information will no longer under the control of FundBrick and will be subject to the terms of that third-party social network's privacy policy.


  • FundBrick may share your personal information with service providers who perform services on our behalf, such as the Automated Clearing House (ACH) and other payment processors, customer service providers, and data analytics providers, which may include Dwolla and Plaid, but only for the purposes provided for by this Policy.   • FundBrick may share your information in connection with a merger, acquisition, or sale of all or a portion of our assets. If this occurs, FundBrick will require the new combined entity to follow this Policy with regards to your personal information. If your personal information could be used for purposes not proscribed by this Policy, you will receive prior notice and the opportunity to communicate your preferences.


  • When you authorize a third-party service provider to access your data, or when you authorize an account connection with a third party, FundBrick may disclose your personal information to that third party. 


  • FundBrick may disclose your personal information to law enforcement, government officials, or other third parties if we are compelled to do so by a subpoena, court order, or similar legal procedure. We may be compelled to disclose personal information in these circumstances when it is necessary to prevent physical harm or financial loss, to report suspected illegal activity, to investigate violations of the FundBrick Terms and Conditions, or as otherwise required by the law.


  • We may disclose your personal information to protect our rights or interests, such as to investigate potential violations of our policies or to prevent fraud or other illegal activity.


UPDATING YOUR INFORMATION


To ensure that your personal information is accurate and up to date, you can make changes to your personal profile on our Platform at any time. This includes updating your user profile, registration details, banking information, and email addresses. If any information is incomplete, inaccurate, or outdated, please update it promptly.


YOUR CHOICES


You may choose to opt-out of certain communications from us by following the instructions in those communications and updating your preferences on our Platform. Please note that even if you opt-out of certain communications, we may still communicate with you for administrative, transactional, or other non-marketing purposes.


If you want to cancel your personal profile and enrollment, you may do so in our Platform settings. Please keep in mind that deleting the mobile application without deleting your account won't close and delete your personal profile. After you delete your account, we will continue to retain your data per the retention policies mentioned above.


YOUR RIGHTS


The law provides you with rights regarding your personal information:


  • Request a list of third parties we’ve shared personal information within the past year, including the names and addresses of those third parties;


  • Know what categories and specific pieces of personal information we've collected about you, the business purposes for collecting it, the categories of sources we've collected it from, and the categories of third parties we've disclosed it to;


  • Request corrections to any inaccurate personal information we maintain about you;


  • Request the deletion of your personal information;


  • Restrict the use of sensitive personal information; 


  • Refuse the sale or sharing of your personal information;


  • Not face discrimination for exercising your privacy rights;


  • Access the personal information we've collected about you in the past year upon request; and


  • Challenge any rejection of your requests for the aforementioned rights.


To exercise your privacy rights, you can submit a request by emailing us at support@fundbrick.com. Upon receipt of your request, we will acknowledge it and provide an estimated completion time, which will typically be 45 days or less. To verify your request, we may request additional information from you or use a third-party identity verification service. You may designate an authorized agent to make a request on your behalf by providing a signed authorization and additional identity verification.


CHANGES TO THIS POLICY


We may update this Policy from time to time to reflect changes in our practices or applicable laws. We will post updates to this Policy on our Platform and if the changes are significant, we will provide a more prominent notice. Your continued use of our Platform after we make changes to this Policy will signify your acceptance of the new terms.

  • Your personal information may be shared with non-affiliated third parties if it is necessary to complete a transaction or to provide you with a financial product or service that you requested or authorized. 


  • Your personal information may be shared in connection with maintaining or servicing your account or as part of a credit card program or other credit extension. 


  • Your personal information may be shared may be shared in connection with the sale of servicing rights or other transactions related to a transaction you made.


  • Your personal information may be shared with your consent.

Vermont residents: If you are a FundBrick user with a Vermont mailing address, we will not share your personal information with non-affiliates unless permitted by Vermont law or authorized by you. Additionally, we will not disclose your creditworthiness information to affiliates and will not allow nonaffiliated third parties to access your personal or financial information, credit report, or health information for marketing purposes, unless permitted by Vermont law or authorized by you.
